Injury

When you are injured as the result of someone else's negligence, the key issues are proving liability and establishing the medical evidence of your injuries. If you were injured in a motor vehicle accident, it is necessary to establish that the other driver was at fault for the accident. To establish liability on a medical malpractice claim you must prove that a health care provider had a duty of care towards you, that they breached that duty of care, that there is a direct link between their negligence and your injuries and that there are no defenses for the alleged negligence.

When you are injured as the result of another person's negligence it is extremely important that the nature and severity of your injuries be well documented by your family physician and/or specialist treating you for your injuries. In order to obtain appropriate compensation, your doctor and/or specialist must be sufficiently familiar with the nature and severity of your injuries and your long-term prognosis (medical future) in order that they can write a detailed medical report at the appropriate time that will provide the basis of any settlement negotiations or judgement at Trial.

It is important to note that there is a two year limitation period for all injury claims, meaning that your claim must either be settled, or your lawsuit commenced, within two years of the date of when the incident of negligence occured.
