It is important that you plan who will take care of your property and personal affairs if you are ever incapacitated. If you have not made a Power of Attorney or Personal Directive, your family will have to apply to court to become your Trustee and Guardian, if you are ever incapacitated. Probate is the process where the court recognizes the authority of an executor. Probate assures certain third parties that your will is valid, and facilitates the distribution of estate assets.
